The petition is for quashing of First Information Report and chargesheet. The learned A.P.P. submits that cognizance has been taken.

In view thereof, no relief under Article 226 of the Constitution of India could be granted.

The counsel for the petitioner submits that the petition is also filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, "the Code"). He submits that he will pursue remedy under Section 482 of the Code.

That being so, the petition shall be treated as an application under Section 482 of the Code.
