By the present application, the applicant seeks quashing of the criminal proceeding pending before the learned Judicial Magistrate First Class, Yavatmal bearing SCC No. 429/2022 instituted by the nonapplicant under Section 138 of the Negotiable Instruments Act.

The contention is that the cheque was given towards security and the arbitration award is under challenge before the learned Principle District Judge. 4.
