This is an application for seeking to quash the charge-sheet arising out of Crime bearing First Information Report No.251 of 2023 registered with the Karanja Police Station, District Bhandara for the offence punishable under Sections 306 read with Section 34 of the Indian Penal Code.

The applicants are the husband and brother-inlaw of the deceased, who committed suicide by drowning in between 07.06.2023 to 09.06.2023.

It is the prosecution case that during the period of three years preceding to the occurrence, both applicants have harassed the deceased and thus abetted to commit suicide.

Learned Counsel for the applicants would submit that though the marriage was solemnized in the year 2016. Till suicidal date no police report nor any proceedings about matrimonial dispute has occasioned. It is stated that there is prolong delay of 20 days in

2 8.apl.154.2024 corrected lodgement of the report. According to the applicants, the material collected during the investigation does not make out a case of instigation of abetment.

Issue notice to the respondents for final disposal, Corrected as per Court's order dated 22.02.2024.

returnable on 08.03.2024. Learned Addl.P.P. waives notice on behalf of the State.

The Trial Court is directed for not to frame charge till further orders of this Court.
