This is an application seeking to quash First Information Report vide Crime No. 157/2023 registered with Police Station Nandgaonpeth, Dist. Amravati for the offence punishable under Sections 504, 506(2) of the Indian Penal Code, Section 3(1)(r), 3(1)(10) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The informant claims to be a civil contractor alleges that the applicant has assigned construction work of his wife. He alleges that though he has received advance of Rs. 4,00,000/-, he spent sum of more than 18,00,000/- and to avoid the payment on the date of occurrence, the applicant abused him in the name of caste and stated about termination of contract.

The learned counsel appearing for applicant would submit that the informant is a Police Constable which has no concerned with the Civil Contractor work. There was
2 911 apl 636.24 agreement between applicant and one Priya Pawar which the applicant has terminated due to differences of issuing legal notice dated 27.04.2023. According to the applicant, to pressurize him, false report has been lodged. 5.
Issue notice to the non-applicants returnable after eight weeks. The learned APP waives service of notice for non-applicant No.1.

In the meantime, investigation may go on, but charge-sheet shall not be filed without obtaining leave of this Court.
