Learned counsel for respondent No.2/ complainant has drawn attention of this Court to the order passed by the learned Judicial Magistrate First Class-2, Buldhana dated 21.05.2025, whereby the investigating officer is directed to properly and impartially make the further investigation in Crime No. 1025 of 2023 and submit the final report.

However, Mr Atharva Manohar, learned counsel for the applicants submits that if the FIR goes, whatever investigation is directed or even if carried out will also go. As the order dated 21.05.2025 is subsequently passed after the filing of the present application and in the present application the challenge is restricted to the charge-sheet only, he prays for time to amend the prayer clause raising a challenge to the order dated 21.05.2025.

Leave is granted to the applicants to amend the application as sought for and further APP is directed to file an affidavit stating therein the details about the investigation made by the investigating officer after the said order. 4.
