This is an application seeking to quash the charge sheet bearing Criminal Case No.223/2008 arising out of first information report bearing Crime No.19/2008 registered with Khaperkheda Police Station, District Nagpur for the offence punishable under Section 379 read with Section 34 of the Indian Penal Code.

It is brought to our notice that the main Rgd.

Order 2304apl663.24 accused has approached to this Court by filing Criminal Application No.794/2015 seeking quashing of the crime in which this Court vide order dated 05.07.2016 has issued Rule, and granted interim in terms of prayer clause [b] therein The learned Senior Counsel would submit that prayer clause [b] of the said application pertains to stay of the proceedings before the trial Court.

In view of above, issue notice to the non-applicant, returnable on 11.06.2024. Learned A.P.P. waives notice for the non-applicant. To be heard along with Criminal Application Nos.794/2015 and 276/2013.
