This is an application seeking to quash the First Information Report No.159 of 2024 registered with the Shegaon Police Station, District Buldhana for the offence punishable under Sections 323, 498-A, 504, 506 read with Section 34 of the Indian Penal Code.

The applicant no.2 is the practicing Advocate whilst applicant no. 1 is his wife who are neighboring resident of the informant. It is submitted that the applicants are nowhere related with the family however they have been named as distinct relative in the complaint alleging matrimonial harassment. Accordingto the applicants they being not related to the family, the provisions of Section 498-A of the IPC cannot be invoked against them.

Issue notice to the non-applicants, returnable after eight weeks. Learned Addl.P.P. waives notice on behalf of the State.

In the meantime, investigation may go on but
2 922.apl.700.2024 charge-sheet shall not be filed without obtaining leave of this Court against the present applicants.
