By this application the applicants are seeking quashing and setting aside of the Charge-sheet being RCC No. 81 of 2024 pending on the file of 3rd JMFC, Yavatmal arising out of the First Information Report No.1379 of 2023, registered by Police Station Awadhutwadi, Yavatmal for the offence punishable under Sections 3 and 4 of Dowry Prohibition Act, 1961 and Section 498-A r/w 34 of the Indian Penal Code.

2. Applicant No. 1 is the husband and is present through video conferencing. Applicant Nos. 2 to 5 are the inlaws of non-applicant No. 2. During the pendency of the present application, the dispute has been amicably settled

2 / 3 21-apl 788-24 between the parties. Applicant No. 1 has obtained divorce from non-applicant No. 2.

Non-applicant No. 2 has also appeared through video conferencing and has been duly identified by her learned Advocate. She has stated that she has no grievance whatsoever against any of the applicants. She further stated that, following the dissolution of marriage with applicant No. 1, she has no grievance against the in-laws as well. 4.

Non-applicant No. 2 has expressly stated that she has no objection for quashing and setting aside the chargesheet, being RCC No. 81 of 2024, pending on the file of the learned 3rd Judicial Magistrate First Class, Yavatmal, filed against the applicants.

In view of the settlement and the statement made by non-applicant No. 2, and as she has no grievance against the applicants, Charge-sheet being RCC No. 81 of 2024 pending on the file of 3rd JMFC, Yavatmal arising out of the First Information Report No.1379 of 2023, registered by Police Station Awadhutwadi, Yavatmal for the offence punishable under Sections 3 and 4 of Dowry Prohibition Act, 1961 and Section 498-A r/w 34 of the Indian Penal Code is hereby quashed and set aside only subject to the applicants and the Non applicant No.2 depositing Rs.10,000/- (rupees ten thousand only) each with the Public Welfare Account

3 / 3 21-apl 788-24 maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 and producing the receipt thereof on record within three weeks.

6. The application is allowed in the above terms and disposed of.
