2. The applicant has challenged the Charge-sheet being Sessions Case No. 47 of 2024 pending before the District and Sessions Court No.3 and the First Information report No.75 of 2024 for the offence punishable under Section 376,376(2) (f),376(2)(n) and Section 506 of the Indian Penal Code, 1960. 3.

It is alleged that the applicant, who is the brother-inlaw of the victim, committed rape when she went to his house, after he had called her and gave threats to commit murder of her daughter and husband. The husband of the victim lodged the complaint, as the victim had informed him about the harassment caused by the applicant.

4, The non-applicant is present before the Court and has filed an affidavit on record. She has been duly identified by her advocate. She has stated that, as the applicant is her brother-inKavita

2 / 2 69-apl 790-24 law, and with a view to maintain family relations, the matter has been amicably settled between the parties. She has further stated that she is not willing to proceed with the case. 5.

In view of the settlement, though serious allegations have been made, the victim is not desirous of prosecuting the matter any further. Hence, in view of the above, the charge-sheet being Sessions Case No. 47 of 2024 pending before the District and Sessions Court No. 3, as well as First Information Report No. 75 of 2024 registered for the offences punishable under Sections 376, 376(2)(f), 376(2)(n), and 506 of the Indian Penal Code, 1960, are hereby quashed and set aside, subject to the applicant depositing an amount of Rs. 25,000/- with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur (Account No. 129712010001014, IFSC Code: UBIN0812978), and placing the receipt on record within a period of two weeks.

6) The application is allowed in the above terms and disposed of.
