DATED :- 24.05.2024 By this application, the applicant is seeking to quash First Information Report No. 29/2024 registered with Police Station, Asegaon, Amravati Rural for the offence punishable under Sections 323, 498A, 504 and 506 r/w. 34 of the Indian Penal Code.

Issue notice to the non-applicants, returnable after Summer Vacation.

The learned APP waives service of notice for the non-applicant no. 1/State.

The learned counsel for the applicants submitted that applicant nos. 1 to 4 are the in-laws and applicant no. 5 is the husband of the complainant. He submitted that as far as applicant nos. 1 to 4 are concerned, there is no allegations regarding demand of RR Jaiswal

2 15-apl-848-24.odt dowry against them. They are implicated only because they are nearest relative of applicant no. 5. Now, the investigation is already completed and the Investigating Agency is about to file charge-sheet. As there is no averment made against applicant nos. 1 to 4, the First Information Report (FIR) is liable to be quashed and set aside against them.

Heard the learned counsel for the applicants, perused the recital in the FIR. Considering the submissions made by the learned counsel for the applicants, the investigation may progress but, the Investigating Officer shall not file charge-sheet till appearance of the non-applicants.
