After disinclination is shown, the learned Advocate for the applicants seeks withdrawal of the application. However, taking into consideration the fact that the charge-sheet was filed on 29.05.1980 before the trial Court and it could only be committed to the Court of Sessions in the year 2021 and taking into consideration the fact that some of the applicants are stated to be retiring or have secured a good post coupled with the fact that Article 21 of the Constitution of India gives right to them to have speed trial.

Learned Ad-hoc District Judge-5 and Additional Sessions Judge, Nagpur is hereby directed to expedite the trial and take up possible steps as early as possible as laid down in the procedure. Learned Judge should not waste time in passing orders and if he considers that securing presence of all the accused is not possible even after taking efforts, he may split the trial and proceed with the Kavita

We may also give liberty to the applicants to approach this Court after one year, if the trial does not get over by that time.

Learned PP makes a statement that unnecessary adjournment should be avoided by learned Advocate representing the applicants before the trial Court. 5.
