This is an application seeking to quash chargesheet arising out of Crime No.0117/2020 registered by non-applicant No.1 for the offence punishable under Sections 295-A, 153(A)(1)(b) and 505(2) of Indian Penal Code. 3.

It is applicant's contention that the allegations in particular the script of the offending message does not make out the offence alleged. It is argued that forwarding a message in whats-app group cannot be termed as circulating the material to create hatred in between two groups i.e. in two classes. Moreover the objection regarding sanction has been raised.

Issue notice to the non-applicants for final disposal returnable on 6.9.2024.

Mr. A.R. Chutke, learned A.P.P. waives notice for non-applicant No.1.

In the meantime, there shall be stay to the proceedings.
