This Court by order dated 23.12.2025 referred this matter for mediation as there was an element of compromise between the parties. Learned Mediator after considering the submission of both the parties, has successfully mediated the matter and accordingly, the terms of settlement were recorded before the Mediator on 06.02.2026. The report prepared by the mediator is duly signed by both the applicant No.1 and non-applicant No.2 along with their Advocates. In the said terms of settlement, there is one clause at serial No.6 which reads as under: "6. The party no.1 undertakes to co-operate for quashment of FIR no.269/2024 dated 10/04/2024 and chargesheet filed before the Ld. Judicial Magistrate First Class, Nagpur and proceedings registered as RCC No.5720/2025 in all manners including her presence before the

In view of above, as the matter is amicably settled between the parties and in view of the judgment of the Hon'ble Supreme Court of India in case of B.S. Joshi and ors. Vs. State of Haryana and Ors., reported in AIR 2003 SC 1386, there is no impediment to accept the settlement of the parties arising out of matrimonial dispute. I see no impediment to allow the present application.

In view of that the present application is allowed in terms of settlement executed between the parties on 06.02.2026.

In view of this, RCC No.5720/2025 arising out of Crime No.0269/2024 for the offences punishable under Section 498A read with Section 34 of the Indian Penal Code is hereby quashed and set aside.

The application stands disposed of. No order as to the costs.
