This is an application seeking to quash and set aside the Charge-sheet bearing SCC No.7309 of 2016 pending on the file of 14th Jt.Civil Judge Junior Division and Judicial Magistrate First Class, Nagpur arising out of the First Information Report No.3166 of 2016 for the offence punishable under Section 43 of the Juvenile Justice Act, 1986.

The allegations are made that the information was received by the non-applicant No.2 and they raided the residence of Keshav Urkande. On the second floor, he found that there is one room in which the applicant and four others were smoking hookah and therefore, the First Information Report came to be lodged.

The learned counsel appearing for the applicants has stated that the offence, which is registered under Section 43 of the Juvenile Justice Act,1986 is repealed in the year 2000. Hence prayed to quash and set aside the First Information Report.
