This application is seeking to quash First Information Report ("FIR") vide crime No.376/2024 registered with Police Station Mehkar, Dist. Buldhana for the offence punishable under Sections 51, 51(b), 63 of the Copy Right Act, 1957.

The learned counsel appearing for applicant took us through the entire Police Report to contend that the applicant trader has no nexus with seizure of alleged sold product in violation of the Copy Right Act. The Report itself indicates that the seized goods were admittedly purchased from somewhere else.

Issue notice to the non-applicants returnable after six weeks. The learned APP waives service of notice for non-applicant No.1.

In the meantime, investigation may go on but charge-sheet shall not be filed without obtaining leave of this Court.
