This is an application seeking to quash First Information Report in Crime No.406/2024 registered with Police Station Sadar, District Nagpur for the offence punishable under Section 370 read with Section 34 of the Indian Penal Code and Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956.

It is argued that the applicants on the allegations of customer in brothel house have been apprehended. The learned Counsel for the applicants submits that the customer would not fall within the ambit of the provisions of Immoral Traffic (Prevention) Act, 1956. She relied on some decisions, which assure to be tendered later.

Issue notice to the non-applicant, returnable after six weeks.

Learned A.P.P. waives service of notice for nonapplicant/State.

In the meantime, the investigation may go on, but charge-sheet shall not be filed against the applicants without obtaining leave of this Court.
