This is an application seeking to quash the First Information Report No.316 of 2023 registered with the Shirajgaon Police Station, Amravati Rural for the offence punishable under Sections 306 read with Section 34 of the Indian Penal Code.

The informant lady is a wife of the deceased who committed suicide by way of hanging. The informant learnt from her deceased husband that he has invested Rs.30 to 35 lakhs with three to four persons including the present applicant but despite repeated demand they did not repay and therefore, the husband has committed suicide.

Learned Counsel for the applicant would submit that the case, even if accepted as it stands, does not make out an offence of abetment.

Issue notice to the non-applicants for final disposal, returnable after six weeks. Learned Addl.P.P.

2 926.apl.1253.2024 waives notice on behalf of the State.

In the meantime, investigation may go on but charge-sheet shall not be filed without obtaining leave of this Court against the present applicant.
