This is an application seeking to quash the charge-sheet arising out of First Information Report No.34 of 2024 registered at Wani Police Station, District Yavatmal for the offence punishable under Sections 376(2)(n) and 506 of the Indian Penal Code.

The informant married lady aged 35 years has lodged the report alleging that the applicant had established sexual relations under the false promise to marry. Learned counsel for the applicant took us through the contents of the FIR which indicate that initially sexually relations were voluntarily without promise to marry. Moreover, it is submitted that at various places, they had physical relations, which shows that it is a case of consensual relations.

Issue notice to the non-applicants for final disposal, returnable after six weeks. Learned Addl.P.P. waives notice on behalf of the State.
