This is an application seeking to quash the Charge-sheet arising out of First Information Report No.357 of 2021 registered with the Kalmana Police Station, Nagpur City for the offence punishable under Sections 324, 325, 504 read with Section 34 of the Indian Penal Code.

It is the applicant's contention that the incident was otherwise for which applicant no. 1 has already been lodged the report immediately on the date of occurrence. According to the applicant to give counter check, on the following day existing report has been lodged. 4.

Issue notice to the non-applicants for final disposal, returnable after four weeks. Learned Addl.P.P. waives notice on behalf of the State.

The Trial Court shall not insist for the presence of the applicant excepting the date of framing charge, subject to not challenging the identity.
