This is an application seeking to quash First Information Report vide Crime No.431/2024 registered with Police Station Gadchiroli for the offence punishable under Sections 376(2)(n), 506 of the Indian Penal Code, 1860.

At the instance of report lodged by married lady aged 23 years, the crime has been registered. She alleges that the applicant by putting her under threat, has sexually exploited.

The learned Counsel appearing for the applicant would submit that it is a case of consensual relationship. It is argued that since the relationship was exposed to her husband, a false report has been lodged.

Issue notice to the non-applicants, returnable after six weeks.

Learned A.P.P. waives service of notice for nonapplicant/State.

In the meantime, the investigation may go on, but charge-sheet shall not be filed against the applicant without obtaining leave of this Court.
