In the present matter, the learned APP has pointed out that the charge-sheet is already filed on 11/07/2024. Thereafter, the present application came to be filed before this Court, wherein the interim directions were issued that the charge-sheet should not be filed without leave of this Court.

It is the submission of the present applicant that, till date, he has not received the summons from the learned Magistrate informing him about filing of the charge-sheet, and therefore, same was not filed in the matter.

Learned APP states that, till date, before the learned Magistrate, the matter is at the stage of awaiting issuance of summons. 4.

In the circumstances, in my opinion, it will be proper to allow to withdraw the present application, with liberty to challenge the charge-sheet which is already filed by prosecution in the matter. 5.

The applicant is further permitted to take any other steps as may be permissible under the provisions of law. All the issues are kept open. 6.
