DATED : 17 -10-2024 This is an application for quashing of Chargesheet bearing No. 50 of 2020 arising out of First Information Report No. 121/2019, registered with Police Station Dhamangaon Railway, for offence punishable under Sections 384, 501 and 506 of the Indian Penal Code.

The learned Counsel for the applicant would submit that since there is no delivery of property, an offence of extortion would not constitute. In support of the said contention, reliance is placed on the decision of Hon'ble Apex Court in the case of Issac Isanga Musumba and Others Vs. State of Maharashtra and Others[(2014)15 SCC 357].

Issue notice to the respondents, for final disposal, returnable on 14.11.2024.

Ms. Mehta, the learned APP waives service of notice for respondent No.1/State.
