The petitioner has approached this Court for quashing of charge-sheet.

The learned A.P.P. submits that cognizance is already taken.

That being so, remedy under Article 226 of the Constitution of India will not be available to the petitioner. The petition, however, has also been filed under Section 482 of the Code of Criminal Procedure, 1973 (for short "Code"). The learned Counsel for the petitioner submits that he will pursue remedy under Section 482 of the Code. 4.
Permission is granted. The petition shall be treated as an application under Section 482 of the Code. 5.
The Registry shall list the application before the appropriate Bench.
