Learned A.P.P. submits that the charge-sheet has been filed and cognizance has been taken.

That being so, remedy under Article 226 of the Constitution of India will not be available to the petitioner. The petition, however, has been also filed under Section 482 of the Criminal Procedure Code ("Code"). Learned counsel for the petitioner submits that the petitioners would pursue the cause under Section 482 of the Code.
