DECEMBER 11, DECEMBER 11, (1) The Application has been filed for quashing of F.I.R. No. 889/2024 registered with Panchpaoli Police Station, Nagpur for offence punishable under Sections 316(2), 316(5), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita (BNS). By reply, the Respondent No. 2 has placed on record his unequivocal support for quashing of the F.I.R. No. 889/2024 dated 05/11/2024 in view of the settlement arrived at between the parties. Through mutual understanding and in the interest of maintaining harmonious relations, a settlement has been reached between the Applicants who are the Directors of M/s. Armors Developers Private Limited, M/s. Virani and Company Financial Services and Mr. Virendrasingh Shekhawat. It also appears that this settlement has been crystallized through a Compromise Application dated 03/12/2024 filed before the learned Civil Judge Senior Division, ....A....
14apl1669.24 14apl1669.24 Nagpur in Special Civil Suit No. 1236/2024 (Old R.C.S. No. 102/2024). The aforesaid civil dispute between the parties has been withdrawn in terms of the Compromise Pursis (Exhibit 45). The parties were personally present before the Court and the Court has passed the order below Exhibits 45, 46, 48 and 49. Accordingly, the order came to be passed below Exhibit 1 dated 04/12/2024 by which the Suit is disposed of as withdrawn unconditionally against the Defendant Nos. 3, 4 & 7. The Suit is disposed of between the Plaintiff and the Defendant Nos. 1,2, 5, 6 & 8 in terms of the Compromise at Exhibit 46. (2) The present crime has been registered on the basis of the very same dispute which was subject matter of the Suit, which has been amicably settled between the parties in the Civil Court.
The offence cannot be termed as heinous or anti social. Having regard to the facts, we deem it fit to exercise our inherent powers. (3) As such, the Application for quashing of the F.I.R. No. 889/2024 dated 05/11/2024 registered with Panchpaoli Police Station, Nagpur against the Applicants is allowed and F.I.R. No. 889/2024 dated 05/11/2024 is hereby quashed and set aside.
