It is the contention of Mr. Kumbhar, learned Counsel appearing for the Applicant that the signature on the cheque is admitted. The cheque has been dishonoured for want of sufficient funds. He submits that the cheque has been issued for repayment of the money paid by the Applicant to the Respondent No.1 as the Respondent No.1 has failed to give possession of the flat to the Applicant.

Accordingly, leave is granted. Arguable questions are raised. Admit. Action to be taken under Section 390 of the Code of Criminal Procedure, 1973.
