Heard Mr. Awasthi, appearing in-person who has also advances submissions on the Interim Application, where he seek amendment in the Petition. He has also tendered written notes of his argument.
Ms. Takalkar, would rely upon the reply affidavit filed by the State opposing the Interim Application, as according to her the whole issue stand settled in the wake of the decision of the Full Bench delivered on 05.04.2017 as all the core issues that were referred, are answered in the Chaitanya
2/2 29-Wp-3549-2014.doc affirmative and there is no scope for the further relief for a declaration that the State Government has no power to legislate including amending Section 506(2) of the Indian Penal Code, as cognizable and non-bailable from the commencement of the Constitution of India i.e. 1950. 2.
Since we have heard Mr. Awashti on all distinct aspects which he has attempted to canvass, list for passing orders on 08.07.2024.
