A peculiar situation has arisen in this application. Notices/ Practice Directions dated 19th January 2024 and 8th February 2024 indicate that such application can be listed before the Court assigned to handle such bail applications, if the concerned Judge, who had dealt with the earlier bail application of the applicant, is either not available in the station or is part of a Division Bench. But, prior thereto, by an administrative order dated 4th July 2023,

bipin prithiani 908-ba-758.23.doc the Hon'ble the Chief Justice had specifically allotted hearing of this bail application before Hon'ble Smt. Justice Revati Mohite Dere, in the light of the fact that the said Hon'ble Judge had disposed of the earlier bail application of the applicant, by an order dated 10th March 2021, passed in Criminal Bail Application No. 3445 of 2019.

It is relevant to note that the said Hon'ble Judge did consider and pass an order in the present application also on 19th January 2024, adjourning the same to 2nd February 2024. 3.

This Court is informed that on 2nd February 2024, no effective order was passed.

In such a situation, the office is directed to take appropriate orders on listing of the present bail application before the appropriate Bench.

The learned counsel for the applicant is granted liberty to pursue the matter with the office and upon the clarification in this regard being issued, liberty is further granted to the learned Counsel for the applicant to mention this application before the appropriate Bench for early listing.
