IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION INTERIM APPLICATION NO.429 OF 2024 IN CRIMINAL APPEAL NO.113 OF 2024 Eknath Tukaram Sutar ...Applicant

IN THE MATTER BETWEEN

Eknath Tukaram Sutar ...Appellant

Versus

The State of Maharashtra

...Respondent

_______________________ Mr. Aniket Vagal, for the Applicant.

Ms. Kranti T. Hivrale, APP for the Respondent-State. _______________________ CORAM : SUMAN SHYAM & SHYAM C. CHANDAK, JJ.

DATED : 30th JULY, 2025 P.C. :- 1.

After hearing the arguments advanced by the learned Counsel for both the sides, we are of the view that instead of considering the Application for suspension of sentence the proper course of action would be to hear and finally dispose of the Appeal itself on an early date. This we say so in view of the fact that the Applicant/Appellant is in custody since more than last 12 years.

2.

As such, we direct the Appeal to be listed for final hearing along with the Interim Application on 21st August, 2025. 30th July, 2025

Manoj 16-IA-429-2024.DOC 3.

If the Appeal is not heard on the next date for any reason, the Applicant would be at liberty to press the Interim Application. (SHYAM C. CHANDAK, J.) (SUMAN SHYAM, J.) 30th July, 2025
