The Applicant, who is the legal heir of the Original Revision Applicant - Mohamed Iqbal Rangrej, is seeking relief that an amount of Rs.35,000/- deposited before the District Court, Pune, be allowed to be refunded to the Applicant.

Perusal of the record shows that Criminal Revision Application No.500 of 2013 has been filed by the Revision Applicant-Mohamed Iqbal Rangrej.

In Criminal Revision Application No.500 of 2013 filed by the Original Revision Applicant, a learned Single Judge has passed the

16-IA-501-2025.doc following Order on 13th December 2013:

"Heard Counsel appearing on behalf of the Applicant. The Applicant has been convicted under the Railways Property (Unlawful Possession) Act 1966. I have gone through the judgment of the Learned Trial Magistrate as well as appellate Court. The Applicant has a good case to argue. Hence, the Applicant be released on bail of Rs.30,000/- with one surety in the like amount or cash deposit of Rs.35,000/-, The substantive sentence imposed by the Trial Court and confirmed by the appellate Court shall remain suspended during the period of bail. The Application stands disposed of." (Emphasis added) 4.

Thereafter, subsequently the Revision Applicant-Mohamed Iqbal Rangrej passed away on 23rd September 2015 and thereafter a learned Single Judge by Order dated 9th December 2024 disposed of the Criminal Revision Application No.500 of 2013 as abated. 5.

In these circumstances, the Applicant who is the son of the Original Revision Applicant-Deceased - Mohamed Iqbal Rangrej, has filed an application seeking refund of the amount of Rs.35,000/- deposited before the learned Trial Court.

Accordingly, the Applicant - Ashraf Mohammad Rangrej is permitted to withdraw said amount of Rs.35,000/- deposited before the learned Trial Court.

The Interim Application is disposed of in above terms with no order as to costs.
