Heard learned counsel for the applicant.

The application is made for permission for renewal of the passport which expired on 02.10.2017. This application also contains a prayer that the applicant be permitted to travel to Germany as his daughter is pregnant. The applicant was convicted for the offence punishable under Section 304-II read with 34 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for two 1/2

PMB 20.IA.647-24.doc years and to pay a fine of Rs.10,000/-, in default to suffer simple imprisonment for six months.

Keeping the application pending, the applicant can be permitted to apply for re-issuance/renewal of the passport. If such an application is made, the respondent No.2 to consider the same in accordance with law expeditiously. After the passport is renewed, the applicant may move this application for seeking permission to travel abroad placing the travel itinerary and relevant travel details on record. 4.

List the application on 02.04.2024.
