This is an application for suspension of sentence and bail.

The application is opposed by learned APP.

Pursuant to the conviction by the Appellate Court by the judgment and order dated 24.01.2024 the applicant was taken in custody and is now in custody for almost one month. The sentence is of one year rigorous imprisonment. The Criminal Revision Application which has been admitted is not likely to be heard during this period. The applicant 1/3

was on bail during the trial. He has not misused his liberty while on bail during the trial. Considering the short sentence and that the applicant has already undergone one month of the sentence imposed, I am inclined to suspend the sentence and enlarge the applicant on bail. However as notice is required to be issued to the respondent No.2, I am inclined to enlarge the applicant on interim bail. 4.

Issue notice to the respondent No.2, returnable on 16.04.2024.

Hence, the following order :-

O R D E R

(a) The applicant-Yogesh Ashok Sawant shall be released on interim bail on his furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount.

(b) The applicant is permitted to furnish cash bail surety in the sum of Rs.15,000/- for a period of 6 weeks in lieu of surety.

(c) On being released on bail, the applicant shall furnish his contact number and residential address to the Trial Court as well as the Investigating Officer and shall keep them updated, in case there is any change. 2/3
