Heard learned counsel for the Applicant, learned APP for the State and learned counsel for the Respondent No.2. 2.
Learned counsel for Respondent No.2 tendered affidavitin-reply, it is taken on record. 3.
By this application, the Applicant is seeking cancellation of bail of Respondent No.2, on the ground that Respondent No.2 is not Shantanu Dhudum 1/2
40-IA-847-2024 (CR).doc attending the Court regularly.

Learned counsel for Respondent No.2, on instructions, submits that the Respondent No.2 undertakes to appear regularly before the trial Court and will not seek adjournment for two consecutive dates.

Learned counsel for the Applicant submits that though the offence was registered in the year 2018, yet charge has not been framed against the Applicant, hence direction be given to the trial Court to frame the charge.

In view of the above, the Applicant shall make the same submissions before the trial Court and the trial Court shall decide the matter on its own merit, taking into account the year of the matter. 7.
