By this Application, the Applicant seeks relaxation of condition (e) imposed by this Court vide order dated 27th October, 2023, in Criminal Bail Application No.2941 of 2023, whereby the Applicant was restricted from entering Mumbai / Mumbai Suburban, Thane and Palghar districts till the conclusion of the trial.

Mr.Khan, learned counsel for the Applicant, submits that the statement of victim has already been 14th October 2025

Prasad Rajput (P.A.) 50-IA-1104-2024.doc recorded before the Trial Court on 1st March, 2024. He submits that the Applicant was doing scrap business prior to his arrest and he is deprived of his livelihood since he is restricted from entering Mumbai / Mumbai Suburban, Thane and Palghar districts.

Ms.Bhosale, learned APP, concedes that statement of the victim has been recorded.

Considering that the statement of victim had already been recorded and also that no purpose will be served by restricting the Applicant from entering Mumbai / Mumbai Suburban, Thane and Palghar districts. Hence, the said condition is relaxed.

Rest of the order shall remain as it is.

It is made clear that any infraction arising out of relaxation of condition (e) shall entail cancellation of bail. 7.

Interim Application is allowed in the above terms and disposed of.
