This is an Interim Application seeking modification of clause (d) of paragraph 4 of order dated 27th February 2023. By way of the said clause, the Applicant is directed to report to the Investigating Officer once in a month on every Monday of the month between 11.00 a.m. and 1.00 p.m.

Mr. Hamzah Kazi, learned counsel appearing for the Applicant, submits that the Applicant is a permanent resident of Muradabad, Delhi and he is put to tremendous expense and loss of wages when he has to travel from Muradabad to Mumbai every month to report to the Investigating Officer. In this context, he also submits that there is no progress in the trial, till date charges are not framed. He also submits that the Applicant has complied with the conditions of the bail order till date and hence, he prays that clause (d) of paragraph 4 of the bail order dated 27th February 2023, be modified. 3.

Ms. Anamika Malhotra, learned APP representing the State in the matter, submits that clause (d) can be modified subject to modified condition be imposed that in stead of reporting to the police station in Mumbai, the Applicant be directed to report to the police station at Nagphani in District: Muradabad, Delhi, which has the jurisdiction in the location where the Applicant currently resides.

Having heard both the parties, I am of the view that since the trial has not progressed and even charges are not framed and also considering that the Applicant has complied with the conditions till date, interest of justice will be subserved if the said clause is modified to the extent that in stead of reporting to the Investigating Officer in Mumbai on every Monday of each month, the Applicant attends the police station at Nagphani in District: Muradabad, Delhi on first Monday of every month between 11.00 a.m. and 1.00 p.m. It is also made clear that if the Investigating Officer requires the Applicant's attendance at the Police Station in Mumbai, the Applicant will report to the Investigating Officer in Mumbai. 5.

Rest of the order remains as it is.

Interim Application is partly allowed and accordingly, disposed of.
