Heard learned Advocate for the Applicant.

He is Accused No.1 along with one Avinash Digambar Vaidya - Accused No.2. Both are charge-sheeted and tried in R.C.C. No.76 of 2007 by the Court of J.M.F.C., Pen. Both were convicted for the offences under Sections 420, 468 and 471 r/w 34 of the Indian Penal Code (for short "IPC"). Both have preferred an Appeal whereas Appellate Court has acquitted Accused No.2 Avinash Vaidya. In view Pallavi 1/2

19-IA-1563-2024.doc of his acquittal, the Appellate Court modified the conviction for the individual acts of the Applicant and in that sense, conviction is maintained under Sections 417, 471 of IPC and also reduced the sentence and now the sentence is one year and fine of Rs.5,000/-. 3.

There are proved documents but learned Advocate is not having those documents. He has applied for certified copy. Let him file those documents.
