The Applicant was convicted by the Special Judge under POCSO Act, Greater Mumbai in POCSO Special Case No.522/2020 under Sections 376(2)(f)(n), 506(2) of IPC as well as under Section 6 read with Section 9(l)(n), Section 10 read with Section 11 and Section 12 of the POCSO Act. The major sentence imposed on him is RI for twenty years besides imposition of fine.

Learned counsel for the Applicant submitted that the Applicant was in poor financial state. He had to file his Appeal through the Legal Services Authority of this Court. The Advocate appearing for him today was appointed on 12.12.2023. Thereafter she collected the papers and took some time and thereafter the Appeal was filed. Hence, there was a delay of 417 days in filing the Appeal. 3.

Considering these reasons and in the interest of justice, the delay in filing the Appeal is condoned. The Appeal be processed further. The Application is disposed of. (SARANG V. KOTWAL, J.)
