Heard learned Advocate Shri Satyanarayanan for the Applicant - convicted accused. Applicant is proprietor of Proprietary Firm. He is convicted by the Court of Metropolitan Magistrate for the offence punishable under Section 138 of the Negotiable Instruments Act. The sentence is of 6 months and compensation. Whereas, his Appeal is also dismissed by the Court of Additional Sessions Judge, Mumbai on 28th March 2023. Now, he is in jail and undergoing the sentence. There is delay in filing the Revision Application.

Let notice be issued to the Respondent No.1 - original complainant returnable on 8th May 2024. Private service is allowed. Service affidavit be filed before next date.

In fact, in Revision, the Applicant will be only pressing for running of concurrent sentence instead of running of separate sentence. Meaning thereby, the substantive sentence of imprisonment and default sentence should run concurrently i.e. together and not one after another.
