Heard learned counsel for the applicant and the learned APP for the respondent-State.

By this application, the applicant seeks relaxation of condition (c) imposed by this Court, while granting bail to the applicant by order dated 25.09.2023 passed by this Court (Coram: M. S. Karnik, J). The said condition reads as follows:

"(c) The applicant shall attend the Investigating Officer of Chitalsar police station, Thane, once in a week i.e. on Sunday of every month between 11.00 a.m. and 1.00 p.m." 3.

It is submitted on behalf of the applicant that he has been attending the police station once a week, as directed in the aforementioned condition. It is submitted that since the applicant has abided by the said condition for a 1/2

914_IA_1632_24.doc period of about 10 months, this Court may consider modifying the said condition in an appropriate manner.

The learned APP submits that the aforesaid condition was imposed due to the propensity of applicant committing offences under the Narcotic Drugs and Psychotropic Substances Act, 1985. In fact, it was submitted that the antecedents of the applicant were taken into consideration even by this Court, while granting bail.

Considering the time period that has elapsed from the time when the bail was granted to the applicant and also the fact that the applicant has attended the police station once a week, as directed in the aforementioned condition, this Court is inclined to modify the condition to direct the applicant to attend the police station once a month, instead of attending once a week.

In view of the above, the application is partly allowed and condition (c) is modified as follows:

"(c) The applicant shall attend the Investigating Officer of Chitalsar police station, Thane, once a month i.e. on first Sunday of each month between 11.00 a.m. and 1.00 p.m. during the pendency of the trial."
