Mr. Yagnik, the learned APP has invited our attention to the order passed by the Division Bench on 24.01.2018, which reads to the following effect:

"Taking into consideration the observations made by the learned Trial Judge, specifcally in paragraph 132 of the judgment and order, we do not fnd that a case is made out for grant of bail during pendency of the appeal. The application is rejected".

In the wake of the aforesaid observation, merely because the Appeal could not be heard fnally, in our considered opinion, the present Application cannot be entertained, hence the same is rejected.
