This application is filed by the applicant praying for return of the passport which was surrendered with respondent no.2 as a condition for grant of bail pursuant to the order dated 11th September 2014, passed by this court in Criminal Bail Application No. 945 of 2014.

Learned counsel for the applicant submits that the passport is surrendered with respondent no. 2 on 23rd February 2015. He submits that by order dated 1st August 2017, passed by the Page no. 1 of 2

6-ia-1845-2024-ba-945-2014.doc learned Sessions Court, the applicant is discharged from the prosecution case bearing Session Case Nos. 177 of 2013, 178 of 2013, 577 of 2013 and 312 of 2014. Learned counsel for the applicant therefore submits that the applicant's passport which was surrendered with respondent no.2 be handed over to the applicant.

Learned counsel appearing for respondent no.2 does not dispute that the applicant is discharged from the prosecution. He therefore submits that appropriate orders be passed. 4.

Since, passport was surrendered with respondent no.2 as a condition for the grant of bail and since the applicant is now discharged, the applicant's original passport lying with respondent no.2 be released and handed over to the applicant. 5.

Necessary compliance to be made within two weeks on production of authenticated copy of this order before respondent no.2.

Interim Application is disposed of in the aforesaid terms. 7.
