Though, nobody appears for the applicant, since this Application and Appeal is filed through the counsel on the Legal Aid Panel of this Court, therefore, I have heard learned APP for consideration of this application for condonation of delay. 2.

The Applicant was convicted by the Special Judge, Chiplun, in Special Case No.49 of 2020 vide the Judgment and order dated 19.09.2022. The applicant was convicted for commission of offence punishable under Section 376(AB) of the I.P.C. 14-ia-1894-24 imposition of fine. The major sentence imposed was R.I. for 20 years besides imposition of fine.

It is mentioned in the application for condonation of delay that the Legal Aid Counsel collected the appointment letter on 04.03.2023. The learned counsel had a video conference with the applicant. Some time was lost in communicating with him and getting his instructions.

It appears that, the applicant is poor. He had to file this Appeal through a legal aid counsel. Some time was lost in communicating with the appointed advocate. Hence, there is a delay.

In the interest of justice, delay in filing the Appeal is condoned. The Appeal be processed further.

The application is disposed of.
