Heard the learned Advocate for the Applicant as well as learned APP for the Respondent-State.

By the present Application, the Applicant seeks permission to travel abroad i.e. USA and Austria for the purpose of study board meeting for her daughter and her health check up, respectively, in the month of May, 2024.

Pertinent to mention here that the Applicant is an accused in Crime No.169 of 2016 registered with Khar Police

Station for the offences punishable under Sections 328, 323, 504 of Indian Penal Code (for short 'IPC'). The Applicant was protected by anticipatory bail an a condition that the Applicant should not leave India without prior permission of the Court.

When the Applicant approached before the learned Sessions Court for permission to travel abroad, the Sessions Court rejected the application. The Applicant approached this Court. While granting the permission to the Applicant, this Court directed the Applicant to deposit the passport with Investigating Agency after return journey. Since then the Applicants are being made before this Court for permission to travel abroad. 5.

Earlier also the Applicant have been granted permissions by this Court to travel abroad recently, by the Order dated 12th March, 2024 the Applicant was allowed to travel abroad between March and April, 2024. The Applicant did not misuse the said liberty granted to her, coupled with no objection granted by the learned APP, a case is made out for giving such permission. 6.

Hence, the following order;

ORDER

i.

Interim Application No. 1897 OF 2024 is allowed;

ii.

The Applicant is permitted to travel USA and Austria from 20th May, 2024 till 15th June, 2024. The Applicant shall furnish her itinerary, details of her intended stay and contact numbers with the Investigating Officer.

iii.

Interim Application stands disposed off.
