Heard learned Advocate Shri Patil for the convicted accused. 2.

The substantive sentence is already suspended. Now it is pending for suspension of conviction. He invited my attention to the evidence of PW No.1-Complainant Kedar Jayant Murudkar and V.B. Pawar-PW No.2 and the particulars of the charge on Page-248. According to him, there is a variance in between the evidence of these two witnesses particularly in respect of verification and the actual trap. Whereas the particulars in the charge does not mention about the verification. He relied upon the order passed by this Court
