By this application, learned counsel for the applicant seeks modification of the order dated 11.09.2023 passed by this Court (Coram : M. S. Karnik, J.).

Learned counsel for the applicant submits that this Court directed the applicant to attend the Investigating Officer of Sahar Police Station, Mumbai once in a month [ at clause 8(c) ]. Charge is framed against the applicant. Trial has commenced. Applicant is attending the court dates regularly, hence applicant is finding difficult to attend the police station once in a month. Hence requested to modify / relax the condition No. 8(c) of order dated 11.09.2023. 3.
Learned APP requested to reject the application on the ground that offence under Section 420 of Indian Penal Code, 1860 ('IPC') and 1/2
S.S.Kilaje 35-IA-2045-2024 (CR).doc other Sections of IPC are registered against the applicant. If condition is modified, applicant may abscond, hence requested to reject the application.

I have heard both the learned counsel. Charge has been framed against the applicant. He is attending the trial regularly. The condition imposed in the order dated 11.09.2023 is relaxed and I pass following order :
ORDER
(a) The applicant shall attend the Court dates regularly. 5.
Interim Application is disposed of.
