Heard Ms. Achari, learned counsel appearing for the applicant, Mr. Shirsat, learned counsel appearing for respondent No.1 as also Ms.Ambekar, learned APP for respondent No.2.

By this application, the applicant is seeking modification / deletion of condition (d) imposed by this Court, while granting bail to the applicant by order dated 07.10.2023.

The said condition reads as follows:- "(d) The applicant shall report to the Narcotics Control Bureau, Mumbai Zonal Unit, twice a week, every Wednesday and Sunday, between 10.00 a.m. and 12.00 noon." 4.

The learned counsel for the applicant submits that since the applicant has been regularly attending the proceedings before the MINAL SANDIP PARAB by MINAL SANDIP PARAB Date: 2024.10.04 18:08:11 +0530 1/2

901_IA2049_24.doc concerned Court and the proceedings are being listed regularly every month, this Court may consider deleting condition (d). It is asserted that the applicant has abided by the said condition without any default. 5.

The learned counsel for the respondent No.1 invites attention of this Court to an earlier order dated 04.11.2023 passed by this Court, while considering an application for modification of condition pertaining to surety moved on behalf of the applicant. In paragraph 5 of the said order, this Court had declined to modify any of the other conditions, while reducing the P.R.Bond amount. On this basis, it is submitted that the present application may not be entertained. 6.

Considering the fact that the applicant has abided by the aforementioned condition (d) from the date of the order granting him bail, this Court is inclined to partially modify the said condition. 7.

Accordingly, the application is partly allowed by directing that the applicant shall report to the office of the Narcotics Control Bureau, Mumbai Zonal Unit, once a week, on every Wednesday between 10:00 a.m. and 12 noon.

The Application is disposed of accordingly.
