This is an application for bail pending Appeal preferred by the applicant challenging the Judgment and order dated 16.04.2024 passed by the Special Judge, Kolhapur, in Special Case No.192 of 2021. The applicant was convicted U/s.354 of the I.P.C. and U/s.8 of the Protection of Children from Sexual Offences Act. The major sentence imposed on him was for three years of rigorous imprisonment. It is mentioned in the order that the applicant was an under trial prisoner for a period of 11 months. After his conviction, the applicant was granted bail for a limited period U/s.389(3) of the Cr.p.c. by the learned Trial Judge. Digitally signed by VINOD BHASKAR GOKHALE Date:

Considering this situation and the lesser sentence imposed on the applicant, the applicant can be granted interim bail pending his Appeal, till the Respondent No.2 is served. 3.

Hence, the following order:

O R D E R

i) Issue Notice to the Respondent No.2, returnable on 22.07.2024.

ii) Till 22.07.2024, the Applicant is directed to be released on bail on his furnishing P. R. bond in the sum of Rs.30000/- with one or two sureties in the like amount.

iii) This order shall operate till 22.07.2024. iv) The Investigating Officer shall inform the Respondent No.2 about pendency of this Appeal, the Interim application and the next date of listing.

v) The I.O. shall make a statement about service on the Respondent No.2 on the next occasion.

vi) Stand over to 22.07.2024 (SARANG V. KOTWAL, J.)
