1) This Interim Application has been filed for condonation of delay in filing the Criminal Revision Application. 2) The Applicant is challenging the order dated 18.10.2023 passed by the Sessions Judge, Kolhapur, in Criminal Appeal No.44 of 2022. The said Appeal arose from the order dated Page No.1 of 3
08.08.2022 passed by the Judicial Magistrate First Class (JMFC), Miraj, District Sangli.
3) The Sessions Court passed an order on 18.10.2023. There is delay of 55 days in filing the Criminal Revision Application. 4) It is submitted that, the Applicant, being a layman and belonging to the State of Goa, was not in contact with any Advocate in Mumbai. Therefore, he took some time to search the appropriate Counsel to be appointed in the matter. 5) Apart from that, the Applicant was suffering from blood pressure. Therefore, he could not take prompt steps within the prescribed time limit. The delay is not intentional or deliberate. 6) In view of the explanation given by the Applicant, it is prayed that, the delay in filing the Criminal Revision Application may kindly be condoned.
7) Learned Advocate for the Respondent opposed the Application and submits that, delay is not properly explained. Page No.2 of 3
He tenders a copy of the Affidavit opposing the condonation of delay. The affidavit is taken on record.
8) Considering the explanation given by the Applicant in Paragraph Nos.9 and 10, the Application deserves to be allowed by condoning the delay of 55 days and the Interim Application accordingly stands disposed of.
9) The Petitioner to take instructions about depositing 50% of the amount accumulated towards maintenance till the nullity of marriage, i.e., 04.01.2019.
10) List the matter under the caption "for circulation" on 23.07.2025.
