1) By the present Application, the Applicant in M.A. No. 1555 of 2023 pending on the file of M.P.I.D. Special Court, Gr. Mumbai is seeking extension of 12 weeks time to conclude the hearing of said application. 2) Record clearly indicates that, by an Order dated 16th February 2024, our predecessors had directed the trial Court to decide the said application within a period of eight weeks. We are flummox after reading the application, as it is not submitted by the Registry of the concerned Court, as per the procedure for seeking extension and is filed by the Applicant, who prima facie appears to be not desirous or interested in adjudication of the said application, despite there being a specific direction to that that effect. 1/2

Osk 28-Ia-2139-2024.doc 2.1) In view thereof, the Registrar (Judicial-I) is directed to call for a report from the Registry of the concerned Court, as to why the Order dated 16th February 2024 is not complied with in its letter and spirit. 2.2) The Registrar (Judicial-I) is further directed to call for further report, as to who prompted the Applicant herein to file present application, instead of by the Registry of the trial Court, as per the procedure. This be done within a period of two weeks from today. 3) Stand over to 1st July 2024.
