2/4 P.C. :- This matter was argued for some time. In order to show his bonafide, learned counsel for the applicant submits that the applicant by his e-mail addressed to the advocate has shown readiness to deposit a sum of Rs.54,73,120/- within a period of eight weeks from today. Half of the said amount is Rs.27,36,560/- would be deposited within a period of four weeks from today and the balance amount of Rs.27,36,560/- would be deposited within further period of four weeks from today. 2.

The applicant is permitted to deposit the amount as mentioned above in the proportion of Rs.27,36,560/- within four weeks from today before the Registry of this Court, and the balance amount of Rs.27,36,560/- within a further period of four weeks thereafter.

The said e-mail dated 12th February, 2025 is taken on record and marked 'X'

for identification.

The

3/4 statements/undertaking given in the said e-mail by the applicant is considered as an undertaking to this Court. 4.

The applicant has shown his readiness to deposit the amount which according to him would satisfy the amount claimed by the informant and if the agreement entered into between him and the informant if cancelled, there will be refund according to him of Rs. 12 lacs. The said refund can be received by the informant within a period of two years from the execution of the documents. The said period would come to an end in the month of September 2025. Therefore, in total the informant will be receiving around Rs.66 lacs.

Since the applicant is ready to deposit the amount of Rs.54,73,120/- and the informant is entitled to receive the refund of stamp duty, the applicant needs to be protected in the meantime.

Hence, the matter is adjourned to 17th March, 2025. To

In the meanwhile, the police should not take any coercive steps against the applicant till the next date of the hearing. [RAJESH S. PATIL, J.]
